How to withhold for California resident who works 60% in Colorado?

I have an employee who is a California resident who commutes to work in my company's Colorado office. He works about 60% of the time in Colorado and 40% in California. The company is a Colorado company. How should we withhold state taxes for this employee? We are registered with California EDD. This employee had previously been working for us but entirely in California.

  1. are you registered with EDD in Calif. to withhold and pay the taxes you withhold from him? is he is a Calif. resident he will declare this income along with any other he has on his Calif. return, Calif. expects residents to report income from all sources and Colo will expect income taxes from his income even filing a non resident return for income earned in that state I would say if you are not registered with EDD to pay over his withheld Calif. taxes you cannot withhold them
