Employer has last paycheck for 3 weeks. I lost my daycare. Cant search 4 jobs. Check $881. Small Claims Court?
My last day of work was Nov30Th. I was supposed to get my final paycheck on the 14Th of Dec and it’s now Dec 30th, and I had to cancel daycare stopping me from looking for another job. Can I take him to small claims since check is $881.50, and hold them responsible for me not being able to search forjobs?

- I would its illegal for them to hold your check like this.
- Yeah you have to enroll it then process it through judicial. Also colaborate the typical numerals.
- uh...why not try the department of labor in the state first and get you money; then worry about revenge.
- This is interesting, but how does "when" you received your check change whether or not you needed day care? Did you keep going to work past your last day? I just don't see how not getting paid affected your job search. You have a case against him that he hasn't paid you yet, but I don't see much more than that.
- It would be easier to simply continue asking them politely for your check. Send several letters also. The court will look more favorably when it looks like you made every effort to get your pay without running to the court. Some unanswered letters, a certified letter stating you will take them to court, etc. will help.
- srry thats happened 2 , go thru state dept of labor they handle these cases also see about unemployment insurance. similar things have happened 2 me in one case the threat of legal action got them to pay
